1. Scope
These terms of sale apply to the subscriptions sold by D.G.E. Concept Sàrl on leplatdujour.ch: restaurant owners’ subscriptions and the Gastronauts’ “ad-free” subscription. Subscriptions are offered to restaurant owners established and people resident in Switzerland.
2. Restaurant owners’ subscriptions
- Once registration is approved, the restaurant owner gets a free, no-commitment trial of 30 days.
- They then choose a 3, 6 or 12-month subscription, according to their type of venue (restaurant, mobile, several venues).
- The subscription includes, at no extra cost, the venue page, publishing daily specials and menus, the short page address, the QR code and the board to share, statistics, automatic posts and team access (up to 10 team members).
- During the subscription, the venue page and its daily specials are visible on the service, provided the page is complete and made visible by the owner.
- A temporary closure neither suspends nor extends the subscription.
- When it expires, the page is hidden until a new subscription is paid. The data is kept and the page reappears as soon as payment is made.
- Only the account owner subscribes, pays and sees the invoices; team members have no access to them.
- A restaurant owner’s subscription is concluded in the course of their business.
3. “Ad-free” subscription
The annual subscription removes ads from the site for the Gastronaut account that took it out. It brings no other benefit. A restaurant owner sees the site without ads without having to take it out.
4. Prices
Prices are shown in Swiss francs (CHF) on the site at the time of ordering. D.G.E. Concept Sàrl is not registered for VAT. D.G.E. Concept Sàrl may change its prices; a current subscription is not affected by a price change.
5. Payment
- By card or TWINT (via myPOS), or by PayPal: the subscription is activated as soon as payment is confirmed.
- By QR-bill (restaurant owners only): the subscription is activated when the transfer is received. The bill is payable within the stated period; otherwise it is cancelled.
- Card details are never passed to D.G.E. Concept Sàrl: they are handled directly by the payment provider.
6. Duration and renewal
Subscriptions do not renew automatically. A reminder is sent by e-mail one week before expiry. A new subscription taken before expiry starts at the end of the current period.
7. No right of withdrawal
Swiss law does not provide a general right of withdrawal for online purchases. A paid subscription therefore cannot be cancelled, subject to article 8.
8. Termination and refund
A paid subscription is not refunded pro rata, unless the law provides otherwise. D.G.E. Concept Sàrl may terminate a subscription in the event of a serious breach of the terms of use; the amount for the unused period is then refunded, unless the customer is at fault. If D.G.E. Concept Sàrl stops running the service, the unused period is refunded.
9. Invoices
An invoice is issued for each payment and remains available in the customer’s account for as long as the account exists.
10. Complaints
Any complaint about a payment or an invoice should be sent to admin@leplatdujour.ch within 30 days of the payment.
11. Language, applicable law and jurisdiction
These terms exist in French, German, Italian and English; in case of discrepancy, the French version prevails. Swiss law applies. The place of jurisdiction is the registered office of D.G.E. Concept Sàrl, subject to mandatory legal jurisdictions.
